Genda Phool plagiarism row: 'There's no proof', claims singer Payal Dev [Excusive]

Mere days after crossing 50 million views on YouTube, Jacqueline Fernandez and Badshah's song, Genda Phool, has landed in controversy over plagiarism. In the popular track, there is a line, 'Borlok er Bitilo, lomba lomba chul.....lal genda phool', which is from a Bengali folk song, Borloker Bitilo. Ratan Kahar, who originally wrote the Bengali verse, has not been given credit, and thereby, the makers of Genda Phool have violated the Indian Copyright Amendment Act 2012.

Arghya Bose, a Doctoral researcher from France, has written to West Bengal CM, Mamta Banerjee, saying, "In the capacity of a common but responsible citizen of your state, Madam Chief Minister, I feel obliged and responsible to bring to your notice exploitation of the poor artists of the state of West Bengal at this level by apparently world-renowned artists. It is, indeed, the moral responsibility of the entire population of the state, and more so, the government of the state to protect the interests of the artistic communities of our country. Your government has always shown sensitivity, empathy, and appreciation to the rich intellectual and cultural diversity of Bengal, which has been one of the many foundations of the popularity of your government. I write this mail to you hoping that you will be able to act in favor of Mr. Kahar in this regard, and obtain for him the intellectual and material remuneration that is due to him."

Now, reacting to this allegation, the female singer of Genda Phool, Payal Dev, has claimed that the opposite party doesn't have proof and one can never hold rights for a folk song, which they have used in the track. In an exclusive interview with BollywoodLife, Payal Dev said, "The thing is that they don't have proof. Talks are going on between the company and them. But as far as I know from the sources, they do not have proof. If you go on Youtube, you can see that the same song has been used six to seven times. Credit is not been given to them in Bengal as well.

Payal added that the name of the opposite party has not been mentioned in the IPRS, too. "Their name is not mentioned anywhere. From our childhood, we know this is a folk song, and accordingly, we've used it. It is mentioned on Youtube as well. Basically, there are no rights to folk songs. As far as I know from sources, their name is not even mentioned in the IPRS, then what are they claiming?".
